DNA Evidence and Experienced Trial Advocacy
The rising use of DNA evidence can be an asset or potential threat to defendants. When DNA evidence is used in your case, it is critical that your defense attorney have a comprehensive understanding both of the technical aspects of collection as well as the evidentiary rules supporting use of DNA in court. Inappropriate use of DNA can result in a wrongful conviction. A case where DNA is barred from evidence could also damage your defense. I am Daniel Miller, a successful trial attorney with experience presenting and defending against the use of DNA evidence.

Trial Attorney With Extensive Presentation of DNA evidence
My trial experience began in 1985. I worked as a Special Public Defender for the 16th Judicial Circuit. In 1988, I worked as co-counsel in the famous death penalty case, State of Missouri v. Wacaser. From 1992 to 2009, I was a prosecutor, focusing on murder trials. In 1993, I was voted "Trial Prosecutor of the Year." I have presented DNA evidence in more than 30 of my trials.
I am experienced with all of the following:
- Scientific and technical terminology in the collection of DNA evidence
- Cold hit DNA (Missouri State collection of felon DNA)
- Working with DNA experts in Missouri and nationally
- Use of DNA evidence in homicide investigations
- 4th Amendment Search and Seizure defense in DNA cases
Evidence and Your Rights
Many defendants do not realize the complexity of evidentiary rules or how they will affect the outcome of a criminal case. If you are facing criminal charges, it is important to know that a prosecutor or defense attorney could seriously affect your case, depending on what evidence is presented to the jury. As your attorney, I will investigate your case and challenge any evidence illegally obtained. I will also use DNA evidence where appropriate in the presentation of your defense.
